Living will
A living will explains and details your wishes to your family and physicians on the subject of health care options should you become incapacitated in an end-stage medical condition. If you wish to live on indefinite life support, let your loved ones know far in advance with a properly prepared and executed living will. Remember that the law designed living wills for the convenience of flexibility, so they require periodic updating on a regular basis.
Last will and testament
Don't die intestate (without a will)! Wills precisely express what is to be done with a person’s belongings after he or she dies.
Most states require legal signatures, one from the person whose name is on the will and then one each of two witnesses. Probate
Probate is a court-operated legal proceeding that settles debts and titles to property passed from a decedent to his/her heirs. Probate proceedings take place in courts established in the county where a decedent lived until the time of his/her death.

Estates and trusts
An estate contains the money, assets, and debts that belonged to a decedent. A decedent transfers wealth to heirs and beneficiaries through the estate. In the planning stage, we use wills, trusts, powers of appointment, powers of attorney, and medical powers of attorney (living wills) to make the most of an estate’s value after taxes. We often create trusts, sometimes in conjunction with wills and sometimes as an alternative to wills. Sometimes trusts make it easier for decedents to leave financial gifts to philanthropic endeavors, to non-profit organizations, and even to pets.
