Real estate litigation
Harry offers you a successful track record in real estate litigation involving such issues as title claims, property line disputes, and real estate contracts.
In one of his cases, he represented a homeowner’s rights in a title insurance case. The homeowner had purchased a property for $150,000 and lived there for ten years. One day she noticed a foreclosure notice posted on her front door. The developer had changed the plat (the drawing of the lot in the courthouse) to show that he owned the property on which the house stood when in fact he didn’t. The actual owner foreclosed on the property. The title insurance company sent the homeowner a check for $150,000, which was the face value of her title insurance. However, by this time the homeowner’s property value had appreciated to $450,000.
By law, if the face value of a homeowner’s title insurance is a dollar amount, the title insurance company ends their obligation once they pay that dollar amount. Harry forced the title insurance company to defend the homeowner in an action against the developer. In the end, the property owner received a new deed to her property and the landowner received cash from the developer. One lesson of the case: Harry Blondell always advises homeowners to buy title insurance and look to see if the insurance company offers a title policy where the insurance coverage increases as the property increases in value.
Family farms
Harry helped a number of family farmers receive fair value for their property when they sold their land to developers. What many landowners do not realize is that it can take three to five years to receive payment for a property transferred to a buyer. Rezoning and permit processing must be completed before the sale is final. Environmental issues must also be resolved. Harry helps farm owners by negotiating sales contracts that allow farmers to continue to earn income from their land before sales are finalized. He also negotiates for payment in advance of sales settlements.
Commercial real estate
Every county in Maryland has different zoning requirements for establishing a new commercial property. Harry has experience in dealing with issues such as parking, traffic flow, and architectural and historical issues. He deals with all aspects of real property sales including loan, title, engineering, zoning, land use and lender issues that may affect commercial real estate transactions. He has also represented lenders by providing attorney title and transfer opinion letters.
